Terms of Service

Please read these Terms of Service ("Terms") carefully before using the jessemeup.com website or the Jesse personal stylist application (collectively, the "Service") operated by Jesse ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Use of the Service

Jesse grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulations
• Attempt to gain unauthorized access to any portion of the Service or its related systems
• Reproduce, duplicate, copy, sell, or exploit any portion of the Service without express written permission
• Upload or transmit viruses or any other malicious code
• Harass, abuse, or harm another person through the Service
• Use the Service in any way that could disable, overburden, or impair it

2. Accounts and Registration

When you create an account with Jesse, you agree to provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@jessemeup.com if you suspect unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

3. Waitlist and Pre-Launch

By joining the Jesse waitlist, you provide your email address and consent to receive updates about the Jesse app, including launch announcements and early access invitations. You may unsubscribe at any time by clicking the unsubscribe link in any email we send.

Joining the waitlist does not guarantee early access, a specific launch date, or any particular features. We reserve the right to modify, delay, or cancel the launch at our discretion.

4. User Content

The Service may allow you to upload photos, descriptions, and other content related to your wardrobe ("User Content"). You retain ownership of your User Content. By uploading content, you grant Jesse a limited, non-exclusive license to use, store, and process that content solely for the purpose of providing you with the Service.

You represent that you have all necessary rights to upload your User Content and that it does not infringe any third-party rights or violate any laws.

5. Affiliate Relationships and Shopping

Jesse may include affiliate links to third-party retailers. If you purchase a product through an affiliate link, we may receive a commission at no additional cost to you. We are not responsible for the products, services, or content of third-party retailers. All purchases are governed by the retailer's own terms and return policies.

Jesse does not guarantee availability, pricing, or accuracy of product information from third-party retailers. Prices and availability are subject to change without notice.

6. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Jesse. Our name, logo, and all related marks are trademarks of Jesse. You may not use our trademarks without prior written consent.

7. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

Styling recommendations provided by Jesse are for informational and entertainment purposes only. We make no guarantees about the suitability, fit, or quality of any outfit suggestion or product recommendation.

8. Limitation of Liability

To the fullest extent permitted by law, Jesse shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the twelve months prior to the claim.

9. Indemnification

You agree to indemnify and hold harmless Jesse and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

10. Third-Party Services

The Service may contain links to or integrations with third-party websites and services. We have no control over and assume no responsibility for the content, privacy policies, or practices of third-party sites. We encourage you to review the terms and privacy policies of any third-party services you access through Jesse.

11. Termination

We may terminate or suspend your access to the Service at any time, with or without cause or notice, at our sole discretion. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in California.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the effective date at the top of this page. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
